Payment Terms and Refunds

  • Deposits: A non-refundable deposit (typically outlined in your specific project quote) is required before work begins on any custom project.

  • Final Delivery: Final website files, deployment, or transfer of ownership will only occur after full payment of the agreed-upon project fee has been settled.

  • Refund Policy: Because digital design and development services involve custom labor and immediate resource allocation, all payments and deposits are strictly non-refundable once work has commenced.

Intellectual Property Rights

  • Our Property: All custom code, design frameworks, internal scripts, and proprietary processes created or utilized by Precision Growth Lab remain our intellectual property unless explicitly transferred via a written agreement.

  • Client Property: You retain full ownership of all original content, logos, trademarks, and text provided by you for your project. You grant us a temporary license to use these materials solely for the purpose of completing your project and showcasing it in our portfolio.

Limitation of Liability and Disclaimers

  • Website Functionality: While we build high-performance websites, Precision Growth Lab is not liable for any third-party service outages, server downtime (hosted by providers like TrueHost, HostAfrica, etc.), plugin conflicts, or cyber-attacks.

  • No Legal/Financial Guarantees: We design assets to improve conversions and user experience, but we do not guarantee specific financial results, sales volumes, or rankings on search engines (SEO).

  • Maximum Liability: To the maximum extent permitted by South African law, Precision Growth Lab’s total liability for any claim arising out of our services shall not exceed the total amount paid by the client for the specific project in question.

Indemnification

You agree to defend, indemnify, and hold harmless Precision Growth Lab, its founder, and contractors from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of our services, your website content, or any breach of these Terms.

Governing Law

These terms are governed by and construed in accordance with the laws of South Africa, and you submit to the non-exclusive jurisdiction of the courts located in Pretoria for the resolution of any disputes.
